xPlease be aware of the procedure for using the Town of Owego Virtual Court System.
When you click here, the link for the Virtual Court, you will maintain the same rights as if you have appeared in person.  You will be directed to the Skype for business meeting and you will go directly to the lobby portion of the meeting. Your name will appear in the order in which you logged into the meeting.  Please wait in the lobby portion that you were directed to and the judge will call your case in the order you logged in.  Please be patient as this may take some time depending on how many people are ahead of you.  Once your case is called by the court, you will have the opportunity to enter a guilty or not guilty plea.  If you enter a guilty plea, you will be assessed a mandatory State surcharge and a fine applicable to the charge for which you were given a ticket.  If you enter a NOT GUILTY plea, you will be given an opportunity to discuss a possible reduction to the charge with the District Attorney or will be offered the option to take the case to trial.  If a trial is requested, you can either come to Court OR the Court can conduct a BENCH trial virtually where you will have the opportunity to present your case to the Court and a decision will be made by the Court.  As ALWAYS, the Court is here to ensure a fair playing field  for ALL parties and weigh the merits of your case individually.  You may join by phone at 1+(347)378-4143.  The conference number is 771937087

How do I contact the District Attorney's Office?

Does the court accept credit card payments?
The court does not have a card reader but credit card payments can be made online and/or a toll free phone number. There is a service fee for either service. If you use the website the internet service fee is 3.5% (Minimum $3.50) Phone service Fee is 5% (Minimum $5.00). You will also have to know the PLC (Pay Location Code) for the judge who assessed the fine. For the Hon. John Schumacher the PLC is 5462 For the Hon. Patrick Hogan the PLC is 5463.
What is the surcharge?
The surcharge is mandatory and imposed by New York State on each traffic violation conviction. The surcharge on all moving violations, which includes speeding tickets, is $93. The surcharge on equipment violations is $63.
What is the basis for a small claims case?
The person being sued in a small claims case must reside, work or have a place of business in the Town of Owego, which includes the village. It must be a verifiable Town of Owego address and it cannot be a post office box. If the amount you are suing for $1000 or less, the filing fee is $10; if it is between $1001 and $3000 the filling fee is $15. Hearings in a small claims case are scheduled for at least three weeks from the filing date. Small claims hearings are always held on Thursday – either at 10:00 A.M. or 2:00 P.M.

Jurisdiction is determined by the residence or regular business office of the defendant.

What is needed to file small claims:

  • Name & street address of defendant (no PO Box #)
  • Brief statement of claim
  • Amount of claim
  • Filing Fee – Maximum of $15.00 (No personal checks)
Town Court Civil Suit

Incorporated businesses, individuals who cannot file in Small Claims Court

What is needed to file:

  • Summons & Complaint prepared, signed by either an attorney, or the Court Clerk
  • Summons must be served at least six (6), but not more than thirty (30) days before hearing date
  • A copy of summons & complaint with affidavit of service attached, shall be filed with the court within six (6) days of service
  • Filing Fee – $20.00 (No personal checks)

  1. Notice of Petition
  2. Petition to Recover Possession of Real Property
  3. Applicable Notice to Vacate & Affidavit of Service of same, applicable warrant if seeking removal

What is Needed to File

  • Have Notice of Petition & Petition to Recover Possession of Real Property filled out
  • Have Applicable Notice to Vacate & Affidavit of Service of same with petitions
  • Make sure Respondent (Tenant) is served not more than twelve (12) days or less than five (5) days before hearing date
  • Make sure Notice of Petition & an Affidavit of Service is filed with the court within three (3) days of service
  • Filing Fee – $20.00 (No personal checks)
